J. Michael Luttig, a former United States Court of Appeals judge for the Fourth Circuit, testified before the House Select Committee to Investigate the January 6th Attack on the United States Capitol in the Cannon House Office Building on Thursday in Washington, D.C.
He testified that former Vice President Mike Pence lacked legal authority to prevent Congress from certifying the 2020 presidential election, that doing so would have resulted in a “constitutional crisis,” and that Trump’s post-election measures amounted to a “war on democracy.”
After the vice president’s team reached out to Luttig in the lead-up to January 6 for his advice on the legality of contesting the vote count, he testified on Thursday as part of a broader hearing on the pressure on Pence to reject the election results.
For 15 years, Luttig was a federal appeals court judge, gaining a reputation as one of the country’s most influential and conservative judges.
